Controversial US over the top TV service Aereo will not challenge broadcasters’ desires to take it to the US Supreme Court to rule on the service’s legality.



Backed by leading TV industry figure Barry Diller, Aereo enables users to stream broadcast TV to a range of connected devices such as tablets, phones and laptops, AppleTV (via Airplay) and Roku boxes.



The service has been introduced to a number of the larger US metropolitan areas with Baltimore to be added on 16 December to existing rollouts in Boston, Atlanta, Miami, Salt Lake City, Houston, Dallas, Detroit and Denver. Speaking in November 2013, Diller claimed that it could go on to claim a full 35% of US households should it overcome its legal challenges.



As these come to a head, the much-sued company said that it welcomed a resolution of its right to existence. “We have decided to not oppose the broadcasters’ petition for certiorari before the United States Supreme Court, said founder and CEO Chet Kanojia .While the law is clear and the Second Circuit Court of Appeals and two different federal courts have ruled in favour of Aereo, broadcasters appear determined to keep litigating the same issues against Aereo in every jurisdiction that we enter. We want this resolved on the merits rather than through a wasteful war of attrition.”



Aereo’s argument is that it merely provides antenna and DVR technology that consumers can use to tune an individual, remotely located antenna to make personal recordings on a cloud DVR. ”The plaintiffs are trying to deny consumers the ability to use a more modern antenna and DVR by trying to prevent a consumer’s access to these technologies via the cloud,” Kanojia added.
